We have experience with regulatory compliance, enforcement proceedings and administrative hearings involving the Clean Air Act (CAA), the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund), and the Emergency Planning and Community Right to Know Act (EPCRA), along with their state counterparts. We have defended clients against enforcement proceedings brought by the Colorado Department of Public Health and Environment (CDPHE), Indiana Department of Environmental Management (IDEM) and a number of U.S. EPA Regions, and assisted clients in responding to requests for information issued by the EPA and state environmental agencies under CERCLA, RCRA and the CAA.
Our attorneys have substantial experience performing due diligence for acquisitions, mergers and divestment of businesses, advising real estate purchasers and sellers as to environmental issues relating to commercial and industrial property transfers, and have assisted clients in the remediation and redevelopment of contaminated sites (“Brownfields”) through various state voluntary clean-up programs.
